I advertised my corvette in the news paper to have it sell. In May of 2008 I found buyer that was willing to get a loan and pay off the car within one month. I believed him because he seem honest and claimed to be part of they Hershey family. Anyway, Its January 2009 and we have been back and forth with conversation and the car is still not paid and with late payments. One other fact is that he crashed in July of 2008 but fixed that car. I have been asking for his new address and nothing, phone calls are not answered anymore. I called the local police to see what I could do and they said I cannot even report it stolen because he has done no crime… I really need advice……
There is a written note signed by both of us stating that he will pay off the car. Also, they guy obviously doesnt have money and going to court would cost me more than the car.
The title was not transferred. I am still responsible. One good thing is that he had the car insured only under liability so he was responsible for the damages.
 
Better consult an attorney. He may have skipped town and you are out in the cold.
 
If you have a viable (good) address on the person then go to a Civil Court and file a CLAIM DELIVERY case to get your car or the funds for the car. The person will have to tell the COURT why they haven't paid for the vehicle that they purchased from you or why it hasn't been returned and if they NO-SHOW, then you will win via DEFAULT and then you request a PICK-UP ORDER from the COURT whenever you locate the whereabouts of the vehicle, you contact the POLICE and they will get your property! You could also hire a Repossession Company to locate retreive your vehicle. You can also send a CERTIFIED, with return receipt, LETTER OF DEMAND stating 15 days to return your vehicle or pay for it IN FULL. also note in the demand letter that if neither of the two options are completed, you'll deem this as a BREACH OF TRUST. Keep a copy of the letter, the receipt for mailing and the GREEN return receipt from the ceritified mailing. If nothing is done by the deadline of your writing, proceed to a Magistrate, Judge or other Law Enforcement entity and file a BREACH OF TRUST warrant for their arrest!!!
 
Do you have a written agreement? A promissory note? Anything in writing? Did you transfer title?
